These terms are an agreement between you and HyperCluster Foundation ("HyperCluster", "we", "us"). They cover hypercluster.org and every HyperCluster app and service: Passport, HYPEC and the HyperCluster blockchain (chain 838838), invite friends, HyperAI, HyperCloud, HyperCV, HyperAcademy, Quipu machines and the software for sharing your PC (together, "the services").

This page has a general part, which applies to everything, and a part for each product, which adds the rules for that product. Where a product's part says something different from the general part, the product's part applies to that product.

By creating a Passport, signing in or using any of the services, you accept these terms. If you do not accept them, do not use the services.

Our Privacy Policy explains what data we keep, why, who else receives it and how to ask for a copy, a correction or deletion. Please read it too.

These terms replace all earlier terms of use for the services, including the separate terms each app showed before.

These terms are written in English and in simplified Chinese. If the two versions differ, the English version prevails.

You must be at least 18 years old and able to make a binding contract where you live.

You may not use the services if the law forbids you to, including where you are subject to sanctions, or from a place where using them is against the law. You are responsible for following the laws that apply to you, including on crypto-assets and taxes.

If you use the services for an organisation (for example, a school or company sealing documents with HyperCV), you confirm that you may act for it and accept these terms on its behalf. "You" then means you and the organisation.

The information you give us must be true and kept up to date.

You must not use the services, or let anyone else use them, to:

• break the law, or store, share or seal anything illegal;
• infringe anyone's rights, including copyright, trademarks, privacy and personal data;
• create, store or share sexual material involving children, or any sexual material made or shared without the consent of the people in it;
• spread malware, or anything meant to damage, disrupt or break into systems;
• defraud, deceive, threaten, harass, blackmail or spam anyone;
• launder money, finance terrorism, avoid sanctions or manipulate any market;
• pretend to be someone else, or misrepresent who wrote a document or what it proves;
• get around limits, security, payments or checks, or test our systems for weaknesses without our written permission (to report a weakness, see the contact part below);
• overload or disrupt the services or the network, or use bots or scripts to abuse them;
• open several accounts, or invite yourself, to collect free use or invite rewards you are not entitled to.

If you break these rules, or we reasonably believe you have, we may, without notice: remove or block content; withdraw or mark records; stop share links; hold back or cancel invite rewards and earnings that come from the breach; suspend or close your accounts; and keep and give information to the police or other authorities where the law requires or allows it. Where we must, or think it right, we will report illegal content to the authorities.

Anyone can report content or behaviour that breaks these rules: use the report tools in the apps or write to [email protected]. We may act on a report as described above. We may not be able to tell you the outcome.

你不得利用本服务（也不得让他人利用本服务）从事以下行为：

• 违反法律，或存储、分享、存证任何违法内容；
• 侵犯任何人的权利，包括版权、商标、隐私和个人数据；
• 制作、存储或分享涉及儿童的性内容，或未经当事人同意制作或分享的任何性内容；
• 传播恶意软件，或任何意在破坏、干扰或入侵系统的内容；
• 欺诈、欺骗、威胁、骚扰、敲诈任何人，或向任何人发送垃圾信息；
• 洗钱、资助恐怖主义、规避制裁或操纵任何市场；
• 冒充他人，或歪曲文件的作者或文件所能证明的内容；
• 绕过限制、安全措施、付款或审核，或未经我们书面许可测试我们系统的漏洞（如需报告漏洞，请见下文"联系我们"部分）；
• 使本服务或网络超负荷或受到干扰，或使用机器人、脚本滥用本服务；
• 开设多个账户或邀请自己，以获取你无权获得的免费额度或邀请奖励。

如果你违反这些规则，或我们有合理理由认为你违反了，我们可以不经通知：删除或屏蔽内容；撤回或标记记录；停止分享链接；扣留或取消因违规而产生的邀请奖励和收益；暂停或关闭你的账户；并在法律要求或允许时，保留信息并提供给警方或其他主管机关。在我们必须报告或认为应当报告时，我们会向主管机关报告违法内容。

任何人都可以举报违反这些规则的内容或行为：使用应用内的举报功能，或发送邮件至 [email protected]。我们可以按上文所述处理举报，但不一定能告诉你处理结果。

What you put into the services stays yours: files, notes, documents, photos, messages, datasets, models and anything else you upload or write ("your content"). We do not claim ownership of it.

You allow us to store, copy, encrypt, process, send and show your content only as needed to run the services for you, as these terms and the Privacy Policy describe. That includes, where a product's part says so, passing it to members' machines or to the outside services named in the Privacy Policy. This permission ends when your content is deleted, except for copies we must keep by law and records written to the blockchain, which cannot be removed.

You are responsible for your content. You confirm that you have the right to upload, share or seal it, and that doing so breaks no law and no one's rights.

Keep your own copies of anything that matters to you. The services are not a backup you can rely on alone.

Keep your password, and your wallet's recovery phrase and private key, secret. You are responsible for what is done with your Passport. If you think someone else is using it, change your password, sign out your other sessions in Passport and write to [email protected].

Your wallet. When you create a Passport, Passport makes a wallet for you on the HyperCluster blockchain. Passport keeps the wallet's recovery phrase encrypted with a key our servers hold, so our servers can use the wallet. They use it only to make payments you confirm at the checkout, to take renewals you have switched on, to record your Passport on the blockchain, and when your account is closed.

You can see and download your wallet's recovery phrase and private key in Passport after entering your password. Anyone who has them can take everything in the wallet. We cannot reverse what is done with them.

Your own wallet. You can link a wallet of your own instead. Passport does not check that you control the address you type, so make sure it is yours. When you link your own wallet, Passport deletes the key of the wallet it made for you: save its recovery phrase or move its HYPEC first, or you lose access to it. With your own wallet, you pay at the checkout yourself, and renewals cannot be taken automatically.

If you forget your password, you can reset it by email, or with your recovery phrase (which also signs you out everywhere).

Closing your Passport. There is no button for it yet: write to [email protected] from your Passport's email address. When a Passport is closed, any HYPEC left in a wallet Passport made for it is moved to a HyperCluster wallet, so move what you want to keep to another wallet first. What is kept after closing is explained in the Privacy Policy.

The blockchain is public. Wallet addresses, payments and other transactions on chain 838838 can be seen by anyone, for example on explorer.hypercluster.org, and cannot be deleted or reversed. Network fees on chain 838838 are paid in HYPEC from the wallet that sends.

HYPEC's price. The US-dollar price of HYPEC is set by HyperCluster and shown on hypercluster.org. It is not a market price, and it can change at any time. We do not buy HYPEC back or exchange it for money or other crypto-assets. HYPEC is not an investment: do not buy it expecting a profit. We make no promise about its value or its future uses.

Adding HYPEC with USDT. In Passport you ask to add an amount (from 10 to 10,000 US dollars). Passport shows an address and an exact amount, with cents that tell your transfer apart, valid for 60 minutes. Send exactly that amount of USDT, on the network shown: BNB Smart Chain (BEP-20) or TRON (TRC-20). Once the transfer is confirmed and matched to you, Passport sends HYPEC to your wallet at the HYPEC price at that moment. We take no fee; the network fee for sending USDT is yours.

Mistakes with USDT. Crypto transfers cannot be reversed. USDT sent on another network, or any other token, is not seen by Passport and may be lost. A transfer of a different amount, or outside the limits, is held for our staff to look at. We will try to help, but we do not promise to recover or return crypto sent the wrong way.

Paying at the checkout. Prices are in US dollars. At the checkout, the price (less any discount for locked HYPEC) is turned into HYPEC at that moment's price, rounded up, and shown before you pay. You pay with a HYPEC transfer on chain 838838 from your wallet to HyperCluster. With a wallet Passport made, Passport makes the transfer when you confirm it; with your own wallet, you make the transfer yourself as shown. Renewals you have switched on are taken from your Passport wallet automatically.

Refunds. If an app cannot deliver what you paid for, the same amount of HYPEC is returned to the wallet that paid; the network fee is not. Apart from that, and the cases a product's part describes, payments are final and are not refunded, except where the law requires it.

Locking HYPEC. On hypercluster.org you can lock HYPEC for 3, 6, 9 or 12 months in a locking contract on chain 838838. To lock, you need your own wallet linked to your Passport and open in your browser (for example MetaMask), holding the HYPEC; a wallet Passport made for you cannot lock HYPEC yet. Locked HYPEC cannot be unlocked before the end of the period you chose. While you have HYPEC locked, products cost you less, by the levels shown on hypercluster.org; we may change the levels and discounts.

The locking contract may also add a reward on locked HYPEC, at the rate shown when you lock (today 3 to 12 % a year, depending on the period). Rewards are paid only while the contract's reward pool holds enough HYPEC. They are not a promise of profit.

You are responsible for any taxes on HYPEC you buy, use, earn or hold.

结账付款。价格以美元标示。结账时，价格（扣除锁定 HYPEC 的折扣后）按当时的价格换算成 HYPEC，向上取整，并在你付款前显示。你通过 838838 链上从你的钱包向 HyperCluster 的 HYPEC 转账付款。如果是 Passport 生成的钱包，在你确认后由 Passport 完成转账；如果是你自己的钱包，你需要按页面所示自行转账。你开启的自动续费会自动从你的 Passport 钱包中扣取。

退款。如果某个应用无法提供你已付款的内容，相同数量的 HYPEC 会退回付款的钱包，但网络手续费不退。除此之外以及产品部分另有说明的情况外，付款一经完成即不可退款，法律另有规定的除外。

锁定 HYPEC。你可以在 hypercluster.org 上将 HYPEC 锁定在 838838 链上的锁定合约中，期限为 3、6、9 或 12 个月。锁定时，你需要使用已关联到你 Passport、并在浏览器中打开的自有钱包（例如 MetaMask），且其中持有这些 HYPEC；Passport 为你生成的钱包暂时还不能锁定 HYPEC。锁定的 HYPEC 在你选择的期限结束前无法解锁。锁定期间，你购买产品可按 hypercluster.org 上公布的等级享受折扣；我们可能调整等级和折扣。

When someone creates a Passport with your invite link or code, they are linked to you, for good. Someone who joins without an invite code is linked to an account of the HyperCluster team.

Rewards. When people linked to you buy a product, you get a share of the price they actually paid (after any discount): by default 10 % for people you invited, 5 % for people they invited, and 2.5 % one step further. A product can have its own rates, shown on its page. We may change rates for future purchases. Adding HYPEC with USDT earns no rewards.

Rewards are held for 14 days, in case the purchase is refunded. A refund cancels the rewards still on hold.

After the hold, a reward is turned into HYPEC at that day's price and placed in a release contract on chain 838838, which releases it bit by bit over 90 days. You can take what has been released at any time. You need a wallet in Passport to receive rewards; until you have one, they wait.

Inviting friends is not a job and is not a way to earn a living: we do not promise any income. When you invite people, do not spam, do not mislead anyone about HyperCluster, HYPEC or what they can earn, and do not invite yourself or create accounts that are not real people. We may cancel rewards still on hold that come from breaking these rules.

You are responsible for any taxes on your rewards.

邀请好友不是一份工作，也不是谋生手段：我们不承诺任何收入。邀请他人时，不得发送垃圾信息，不得在 HyperCluster、HYPEC 或可赚取的收益方面误导任何人，不得邀请自己，也不得创建并非真实个人的账户。对于因违反这些规则而产生、仍在暂扣中的奖励，我们可以取消。

AI results can be wrong. What HyperAI gives back comes from the models you train or upload, run on members' graphics cards, and, when a picture is read, from our own AI chips; no outside company writes it. Results can be wrong, incomplete or out of date. Check anything important. Do not rely on a result for decisions about health, law, money or safety.

Do not use HyperAI to get help breaking the law or harming anyone, or to create content that breaks the rules in this page. Only upload photos you have the right to use, and think before uploading photos of other people.

HyperAI credit. You buy credit in packs at the Passport checkout, paid in HYPEC; packs are priced in US dollars. Training, running your models (a chat with one included), picture analysis and API calls are charged from your credit at the prices shown in HyperAI when you use them. Prices for future use may change. Credit does not expire. A model run, a chat with your model or a picture analysis that fails is not charged; a training job is charged for the graphics-card time it used, even when your code ends with an error.

• Credit cannot be turned back into HYPEC or money, and is not refunded, except where the law requires it.
• Free use: each day (by UTC time) HyperAI gives a free amount, today 2 HYPEC, for trying your models in HyperAI (a model on a photo, or a chat with your own chat model). It is used before your credit and does not carry over to the next day. It does not cover training, or calls from your app or AI agent. We may change or stop it.

Training jobs run on members' PCs. A training job runs inside a container on the PC of a member who shares their graphics card. That PC must decrypt and read your dataset and run the software and commands you choose. Containers may be able to reach the internet. Do not use a dataset that holds secrets or other people's personal data you are not allowed to share.

You are responsible for what your training job does. It must not attack, scan or try to get out of the machine or the network it runs on, mine crypto-assets, or do anything else that breaks these terms or the law.

What is kept, and for how long: datasets until you delete them; a training job's results for 7 days after the job ends (download what you want to keep); your models until you delete them, up to 1 GB in all (at most 50 models and 1 GB a file). When you try a model or call it through the API, the photo you send goes to a member's PC that runs the model.

API keys. A key is shown once, when you make it. Keep it secret. Calls made with your key are charged to you. If a key leaks, revoke it in HyperAI straight away.

What happens to your messages, photos, datasets and models is explained in the HyperAI part of the Privacy Policy.

HyperAI 额度。你在 Passport 结账时购买额度包，用 HYPEC 支付；额度包以美元定价。训练、运行你的模型（包括和它对话）、图片分析和 API 调用，按使用时 HyperAI 显示的价格从你的额度中扣除。今后使用的价格可能调整。额度不会过期。失败的模型运行、模型对话或图片分析不收费；训练任务按其使用的显卡时间收费，即使你的代码以错误结束。

• 额度不能换回 HYPEC 或金钱，也不予退款，法律另有规定的除外。
• 免费额度：每天（按 UTC 时间）HyperAI 提供一定免费额度，目前为 2 HYPEC，可用于在 HyperAI 中试用你的模型（用照片试用模型，或和你自己的对话模型对话）。免费额度优先于你的额度使用，当天未用完的不会累积到第二天，也不适用于训练，以及来自你的应用或 AI 智能体的调用。我们可能调整或停止免费额度。

训练任务在会员的电脑上运行。训练任务在分享显卡的会员电脑上的容器中运行。这台电脑必须解密并读取你的数据集，并运行你选择的软件和命令。容器可能可以访问互联网。不要使用含有机密信息或你无权分享的他人个人数据的数据集。

你对你的训练任务的行为负责。训练任务不得攻击、扫描或试图逃出其运行的设备或网络，不得挖矿，也不得从事其他违反本条款或法律的行为。

保存哪些内容、保存多久：数据集保存到你删除为止；训练任务的结果在任务结束后保存 7 天（需要保留的请及时下载）；你的模型保存到你删除为止，总量最多 1 GB（最多 50 个模型，单个文件最大 1 GB）。你试用模型或通过 API 调用模型时，你发送的照片会传给运行该模型的会员电脑。

API 密钥。密钥只在创建时显示一次，请妥善保密。用你的密钥进行的调用由你付费。如果密钥泄露，请立即在 HyperAI 中将其作废。

你的消息、照片、数据集和模型如何处理，见隐私政策中的 HyperAI 部分。

Every Passport comes with 1 GB of HyperCloud free. Bigger plans (today Plus 50 GB, Pro 200 GB and Max 2 TB) are sold by the month or the year, priced in US dollars and paid in HYPEC at the Passport checkout.

How your files are protected. Files and notes are encrypted (AES-256-GCM) on HyperCloud's servers, with keys those servers keep, and the encrypted copies are stored on HyperCluster's storage network. HyperCloud is not end-to-end encrypted: our servers can decrypt your files, and do so to give them to you and to people you share them with. The machines in the storage network only hold encrypted copies. File and folder names, sizes and types, note titles and the start of each note are not encrypted (see the Privacy Policy).

Renewal. When you buy a plan, automatic renewal is switched on. You can switch it off at any time in HyperCloud.

• With renewal on, the next period is charged about a day before the current one ends, from your Passport wallet if Passport made it. If you use a wallet of your own, you pay at the checkout yourself.
• If a renewal cannot be charged, you keep your plan for 7 more days to add HYPEC and renew. After that your account moves to the free plan.
• With renewal off, the plan ends at the end of its period.

When a plan ends, your files stay. If you then use more than the free 1 GB, you cannot upload or add to notes until you are under it, but you can still open, download, share and delete.

Changing plan. A bigger plan starts straight away, and the time left on the old plan is not credited. A smaller plan, or a change between monthly and yearly, starts when the current period ends.

Refunds. Plan periods already started are not refunded, except where the law requires it. If a renewal is charged for a plan you had already changed, it is refunded to your wallet in HYPEC automatically.

Files you may upload. For everyone's safety, programs, scripts, disk images, Office files with macros and similar types cannot be uploaded. A file can be up to 100 MB, and up to 10 files can go in one upload.

Share links. Anyone who has a share link can see the item's name, type and size and download it, until you stop sharing it or delete it. A link to a folder also gives what you add to the folder later. Links made on the website have no password and no end date. You are responsible for whom you share with.

Deleting. Deleted files and folders are kept for 30 days, then removed. To get one back within those 30 days, write to [email protected]. Deleted notes are removed straight away. Machines in the storage network clear their copies over time.

HyperCloud is not a backup you can rely on alone. Keep your own copies of files that matter.

你的文件如何受到保护。文件和笔记在 HyperCloud 的服务器上加密（AES-256-GCM），密钥由这些服务器保管；加密后的副本存放在 HyperCluster 的存储网络中。HyperCloud 不是端到端加密：我们的服务器可以解密你的文件，并在把文件交给你和你分享的对象时解密。存储网络中的设备只保存加密副本。文件和文件夹的名称、大小和类型，以及笔记的标题和开头部分不加密（见隐私政策）。

续费。你购买套餐时会自动开启自动续费，你可以随时在 HyperCloud 中关闭。

• 开启自动续费时，下一期费用会在当前一期结束前约一天，从你的 Passport 钱包中扣除（如果该钱包由 Passport 创建）。如果你使用自己的钱包，需要自己在结账页面付款。
• 如果续费扣款失败，你的套餐会再保留 7 天，供你充值 HYPEC 并续费。之后你的账户将转为免费套餐。

退款。已经开始的套餐期间不予退款，法律另有规定的除外。如果你已经更换了套餐，却仍被收取了原套餐的续费，该笔费用会自动以 HYPEC 退回你的钱包。

可以上传的文件。为了大家的安全，程序、脚本、磁盘映像、带宏的 Office 文件及类似类型不能上传。单个文件最大 100 MB，每次最多上传 10 个文件。

分享链接。任何拿到分享链接的人都能看到该项目的名称、类型和大小并下载，直到你停止分享或将其删除。文件夹的链接也包含你之后加入该文件夹的内容。在网站上创建的链接没有密码，也没有截止日期。你对你分享的对象负责。

删除。删除的文件和文件夹会保留 30 天，之后移除。如需在这 30 天内找回，请发送邮件至 [email protected]。删除的笔记会立即移除。存储网络中的设备会逐步清除其副本。

不要把 HyperCloud 当作唯一的备份。重要的文件请自行保留副本。

Only verified organisations can seal documents or issue credentials. An organisation passes a business check first. People can receive, hold and share documents and credentials, and anyone can check one, for free and without an account.

What a seal proves. When a document is sealed, HyperCV writes to the HyperCluster blockchain the document's digital fingerprint (a SHA-256 hash), the time, the description and the file names, and the wallet of the organisation that sealed it. A seal proves that this exact file existed at that time, has not changed since, and was sealed from that wallet. It does not prove who wrote the document, who signed it, or that what it says is true, legal or valid.

HyperCV is not a notary public, a certification authority or a guarantor, and is not a party to any document or credential. We prove what was recorded, from which wallet, and when. Nothing more.

The organisation is responsible for what it seals or issues: for its truth, accuracy and legality, for having the right to issue it, and, for credentials, for having the holder's agreement or another lawful basis to publish the details shown. If a record is disputed, responsibility for its content lies with the organisation that issued it, not with HyperCluster and not with anyone who checked it.

Checking a record is at your own risk. A genuine seal shows that a file is unchanged and who sealed it. It does not show that the claim in it is true. Make your own checks before relying on it. A seal of a false document proves only that the document was sealed.

What is public. What is written to the blockchain (fingerprint, time, description, file names, wallets, and the reason for any withdrawal) can be read by anyone, for ever, not only by people with the check link. Do not put personal or confidential information in descriptions or file names. A credential's check link shows the holder's name, the identifier and details the organisation entered and, if there is one, the holder's photo.

Withdrawing. An organisation can withdraw its seal or credential, and we can withdraw one that breaks these terms. The record stays on the blockchain, marked as withdrawn. It cannot be erased. Mistakes are corrected by issuing a new record and withdrawing the old one.

Credits. Each new account gets 3 free credits. More are sold in packs at the Passport checkout, priced in US dollars and paid in HYPEC. Sealing a document uses 1 credit, however many files it holds. Credits do not expire.

• A credit used for a seal is not refunded, because the record cannot be undone. If a seal or a renewal fails, its credit comes back automatically.
• If you paid and your credits did not arrive, HyperCV keeps checking for 48 hours and adds them; if they still do not arrive, write to [email protected].
• Unused credits are not refunded, except where the law requires it.

The encrypted copy. HyperCV keeps an encrypted copy of each sealed file for 10 years from the day it is sealed. Before then, the organisation can keep it for 10 more years for 1 credit. After that HyperCV no longer stores the copy, but the record stays on the blockchain, and anyone can still prove the file is unchanged by checking the original file against it. Keep your own copy of every document you seal.

Sharing documents. The holder of a sealed document can make a share link that lasts 7, 30 or 90 days, or does not stop. Anyone with the link can see and download the file. You are responsible for whom you share with. To have a link stopped early, write to [email protected]. Links to claim a document or credential do not expire; the organisation sends them, not HyperCV.

Business checks. To be verified, an organisation gives its details and documents. These are read by software and by an AI service, and checked by our staff where needed; a clear case can be approved automatically. We may refuse or remove verification, for example if details turn out to be wrong or the organisation breaks these terms. Approval is recorded on the blockchain.

Reporting. Anyone with a share link can report the document from the share page, and anyone can write to [email protected]. We may withdraw seals, revoke credentials, remove an organisation's verification and tell the authorities.

The one promise we make about a seal: the fingerprint and time recorded match the file submitted when it was submitted. Everything else about HyperCV is covered by the parts on warranties and liability below.

积分。每个新账户可获得 3 个免费积分。更多积分以积分包形式在 Passport 结账时出售，以美元定价、用 HYPEC 支付。每次存证使用 1 个积分，无论包含多少个文件。积分不会过期。

• 已用于存证的积分不予退还，因为记录无法撤销。如果存证或续存失败，所用积分会自动退回。

关于存证，我们只作一项承诺：记录的指纹和时间与提交时所提交的文件相符。HyperCV 的其他一切事项，适用本页关于保证和责任的部分。

For learning only. Courses and certificates are not investment, legal, financial or other professional advice. A certificate is not an accredited qualification, a licence or a professional certification. It shows only that you finished a course at a given time; it says nothing about your skill or competence.

HyperAcademy is free today. If we ever charge for a course, you will see the price before you start it.

When you pass a course, a certificate is issued to your Passport. When the certificate service is on, it is also recorded on the HyperCluster blockchain to your Passport wallet. The certificate has a public page, and a check link, that anyone with the address can open.

Course materials belong to us or to those who license them to us. They are for your own, non-commercial learning. Do not copy, resell or share them without our permission. We may update or withdraw courses at any time.

Play fair: do not share your account or cheat to get a certificate you did not earn. We may revoke certificates obtained by cheating or misuse. A revoked certificate stays on the blockchain, marked as revoked.

Some lessons may show videos hosted by YouTube; YouTube's own terms apply to them.

You must own the machine, or be allowed to use it this way, and be allowed to use its electricity and internet connection for it. Electricity, internet and wear on the machine are at your cost.

What runs on your machine. Training jobs and model runs run inside containers, separated from the rest of your machine. A training job runs software chosen by the member who asked for it, and can use your internet connection. Storage and the other parts of the software run as ordinary programs. The software may update itself when we publish an update it needs.

You stay in control. You choose what to share, and can pause sharing while you use your PC, set hours, or stop at any time, in Passport or in the software. Unlinking or uninstalling stops all work.

Earnings. You earn HYPEC only for useful work that passes our checks, at rates we set for each kind of work (for example per picture, per hour of graphics card, or per amount of storage kept and proven). Being switched on earns nothing. Rates can change. We do not promise any amount of work or of earnings. Each day's checked work is counted and recorded on the blockchain, and is paid in HYPEC to the Passport wallet the machine is linked to.

Checks. The network checks the work: it sends test pictures with known answers, sometimes gives the same job to two machines, and asks machines that keep files to prove, at random, that they still have them. A machine that fails checks loses standing; repeated failures switch its work off. We may cancel a day's earnings, before they are paid, if the work was wrong, faked or broke these terms.

Rules for owners. Do not interfere with the jobs your machine runs, try to read the data or models in them, fake work or proofs, or change the software to do so. We may stop a machine that breaks these rules from working for the network.

Quipu machines are sold on hypercluster.org and paid in HYPEC. We prepare them and they run our software. We may set them up so our staff can reach them remotely for maintenance. You can cancel an order until it is paid. If a machine does not arrive or does not work, write to [email protected]; you also have the rights the law gives you.

What the network learns about your machine, and what the public network map shows, is explained in the Privacy Policy.

The services, their software, design and text, and the names and logos HyperCluster, Passport, HYPEC, HyperAI, HyperCloud, HyperCV, HyperAcademy and Quipu belong to us or to those who license them to us. These terms do not give you any right to them, except to use the services as these terms allow.

Some parts are open-source software. They are covered by their own licences, which apply instead of these terms for those parts.

If you send us ideas or feedback, we may use them freely, without paying you.

Some parts of the services depend on other companies and networks, such as Cloudflare (which sits in front of our sites), the language-model services that read HyperCV's business-check documents, and the BNB Smart Chain and TRON networks used to add HYPEC. The Privacy Policy lists them and what they receive.

We do not run those networks or the wallets and exchanges you send crypto from, and we are not responsible for them, their fees, their delays or their mistakes.

Links to other websites are for your convenience. We are not responsible for those websites.

Records already written to the HyperCluster blockchain stay there, whatever happens to the apps.

You may stop using the services at any time. To close your Passport and the app accounts that go with it, write to [email protected] from the email address of your Passport. Before you do, move any HYPEC you want to keep to a wallet of your own and download your files (see the Passport part above).

We may suspend or close your access to a service or to all of them if you break these terms or the law, if the law or an authority requires it, if it is needed to protect members, the network or the services, or if we stop offering that service. Unless the law, safety or an investigation prevents it, we will tell you first and give you a reasonable chance to download your content.

Closing an account does not remove anything already written to a blockchain. What happens to each kind of data when an account is closed is explained in the Privacy Policy.

The parts of these terms that by their nature should last after an account is closed keep applying, including payments owed, the rules on content, the disclaimers, the limits of liability, the indemnity and the governing law.

The services are provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties beyond those written in these terms, whether express or implied, including that the services are fit for a particular purpose, of satisfactory quality, free of errors or interruptions, secure against every threat, or that they do not infringe anyone's rights.

Crypto-assets carry risks: prices go up and down, transfers cannot be reversed, networks can fail and keys can be lost or stolen. You accept those risks when you use HYPEC or send USDT.

AI results, course content and the results of checks are information, not advice. They are not legal, financial, investment, tax, medical or other professional advice, and they can be wrong.

The HyperCluster assistant. The chat on our sites gives general information about HyperCluster, written by an outside company’s AI (today DeepSeek) from our own information. It can be wrong or incomplete, and it is not advice. These terms and each product’s own page come first: where the assistant says otherwise, they apply. We may limit how much it can be used, or switch it off. What it does with what you type is in the Privacy Policy (2.5).

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence, or rights you have under consumer law that cannot be waived.

Apart from that, and to the fullest extent the law allows, HyperCluster Foundation and the people who work for it are not liable for:

• indirect, incidental, special or consequential losses, or punitive damages;
• loss of profits, income, business, goodwill or data;
• changes in the price of HYPEC or any other crypto-asset;
• losses caused by someone using your password, sign-in or keys, unless that was our fault;
• crypto sent to a wrong address, on a wrong network or in a wrong token;
• the acts of other members, issuers and machine owners, or of networks and services we do not run;
• decisions you make based on AI results, course content or seals and credentials;
• interruptions, delays and outages.

Our total liability to you for all claims about the services is limited to the greater of: (a) what you paid us for the services in the 12 months before the event that led to the claim (with HYPEC valued in US dollars at the price when you paid), and (b) 100 US dollars.

If someone makes a claim against HyperCluster Foundation, or the people who work for it, because of your content, your use of the services or your breach of these terms, of the law or of someone's rights, you will cover the resulting losses and reasonable costs, including legal fees, to the extent the law allows.

We may update these terms. The date at the top always shows the latest version. For changes that matter, we will tell you in the apps or by email before they take effect, where we reasonably can.

If you keep using the services after a change takes effect, you accept the new terms. If you do not accept them, stop using the services and, if you wish, close your account.

Nothing in this part takes away rights you have under consumer-protection law where you live that cannot be waived.

We may transfer this agreement to an organisation that takes over the services; we will tell you if that happens. You may not transfer it without our written agreement.

We are not responsible for delays or failures caused by events beyond our reasonable control.

We may send you notices by email to the address in your Passport, or show them in the apps or on hypercluster.org.
